Installment loans vs. payday loans in Texas

Personal signature (installment) loans in Texas are governed by Chapter 342 of the Texas Finance Code and are repaid in a fixed schedule of payments. Payday loans and auto title loans are a different product: in Texas they are arranged by Credit Access Businesses (CABs) under Chapter 393 and are usually due in one lump sum. El Paso Credit Access Business ordinance

Since July 1, 2013 the City of El Paso (City Code Chapter 5.17) limits payday and auto title loans arranged by CABs: a payday cash advance may not exceed 20% of the borrower's gross monthly income; an installment payday loan may have no more than 4 installments, each paying down at least 25% of the principal; a single-payment loan may be renewed no more than 3 times, with at least 25% of the principal paid each time; and a new loan within 7 days of paying off the last one counts as a refinance.

Active-duty military (Fort Bliss)

Under the federal Military Lending Act, covered active-duty service members and their dependents cannot be charged more than a 36% Military Annual Percentage Rate on covered consumer loans. Tell us if you or your spouse are on active duty.
